Prize Terms & Conditions

Eligibility

Open to residents of Far North Queensland, the Gulf, the Cape regions, or Woorabinda in Queensland, Australia only. Entry is open to Australian residents aged 18 years or over. By entering, entrants confirm they meet all eligibility requirements and are 18 years of age or older at the time of entry. Black Star Radio reserves the right to request proof of age and residency and to disqualify any entrant who does not meet these requirements.

How to Enter

Entrants may submit multiple entries for each promotion unless otherwise stated. However, each individual is eligible to win only once in any 120-day period. For clarity, the day after a person wins is considered Day 1, and eligibility to win again resumes on the 121st day following their last win.

All entries must be submitted by a real person using their own genuine identity. Entries submitted via bots, scripts, automated means, or false identities will be deemed invalid and disqualified.

Winner Selection & Notification

Unless otherwise stated, winners will be selected by random draw from all eligible entries received during the relevant entry period. The draw will take place at the sole discretion of Black Star Radio.

Black Star Radio reserves the right to redraw a winner at its discretion to ensure fairness and a diverse spread of winners. A redraw may also occur where a winner is ineligible, cannot be contacted within a reasonable timeframe, falls outside the prize provider’s service area, where prize fulfilment is not practical, where eligibility cannot be verified, or where otherwise necessary to ensure compliance with these Terms and the proper conduct of the promotion.

Notwithstanding the above, Black Star Radio may, at its sole discretion, award additional, bonus, surprise, goodwill, sponsor-supplied, promotional or unclaimed prizes to any person who meets the eligibility requirements set out in these Terms. Such discretionary prizes are separate from any advertised competition and are not subject to the winner selection process for that competition.

All decisions are final and no correspondence will be entered into. Winners will be contacted using the details provided at entry.

Prize Conditions

Prizes are non-transferable, non-refundable, and cannot be exchanged for cash or alternative goods or services.

All prizes are supplied directly by third-party providers. Black Star Radio is not responsible for the delivery, quality, safety, condition, availability, or fitness for purpose of any prize.

Any defect, damage, dispute, or complaint regarding a prize must be directed to the prize supplier. To the extent permitted by law, entrants release and hold harmless Black Star Radio from all liability relating to the prize.

Any tax liability arising from acceptance of a prize is the sole responsibility of the winner.

Winners must provide their full name, phone number, and mailing address to facilitate prize delivery. By entering, participants consent to Black Star Radio sharing necessary contact details with the relevant prize provider solely for the purpose of prize fulfilment.

Prize Collection

Prizes must be claimed within 60 days of notification unless otherwise stated. Unclaimed prizes may be forfeited at the discretion of Black Star Radio and may not be reissued.

Prize Donors and Promotional Arrangements

Where a prize is supplied in connection with a sponsorship, promotional campaign, advertising arrangement, or other commercial arrangement with Black Star Radio, any promotional benefits, acknowledgements, mentions, advertising, interviews, or other promotional activities provided in relation to that prize shall be limited to those expressly agreed between the parties, unless otherwise determined by Black Star Radio in its sole and absolute discretion.

Black Star Radio retains sole and exclusive editorial control over all programming, broadcasts, interviews, news, commentary, promotions, digital content, and other published or transmitted content. The provision of a prize does not entitle any sponsor, advertiser, donor, prize provider, or other third party to favourable coverage, endorsements, recommendations, interviews, publicity, preferential treatment, or influence over any editorial, programming, or content-related decision of Black Star Radio.

Nothing in these Terms and Conditions limits or restricts Black Star Radio from providing additional promotional opportunities, acknowledgements, interviews, reviews, product discussions, sponsor mentions, publicity, or other coverage where Black Star Radio elects to do so in its sole and absolute discretion.

Technical Disruption

Black Star Radio is not responsible for lost, late, incomplete, misdirected, delayed, corrupted, or undelivered entries due to technical disruptions, network failures, internet congestion, equipment malfunction, software issues, or any other reason beyond its reasonable control. Continuous or uninterrupted access to entry platforms is not guaranteed.

Regulatory Compliance

Where required by law, promotions will be conducted in accordance with applicable Queensland trade promotion regulations. Any necessary permits will be obtained by Black Star Radio where required.

Use of Entrant Information

By entering, participants grant Black Star Radio permission to use their name, voice, image, and/or submitted content for promotional purposes, including on-air announcements, social media, website publication, and marketing materials related to the promotion, without additional compensation unless prohibited by law.

Limitation of Liability

To the fullest extent permitted by law, Black Star Radio excludes all liability for any loss, damage, injury, claim, cost, or expense arising directly or indirectly from entry into the promotion, acceptance or use of a prize, technical malfunction, or cancellation or modification of the promotion. Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnity

By participating, entrants agree to indemnify and hold harmless Black Star Radio, its employees, contractors, affiliates, sponsors, and partners from and against any claim, demand, liability, loss, damage, cost, or expense (including legal costs on a full indemnity basis) arising from breach of these Terms, misuse of a prize, or negligent or unlawful conduct by the entrant.

Force Majeure

Black Star Radio will not be liable for any delay, cancellation, or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, extreme weather events, fire, flood, pandemic, war, industrial disputes, government restrictions, supply shortages, or technological failure.

Promotion Changes

Black Star Radio reserves the right to amend, suspend, cancel, or modify the promotion or these Terms and Conditions at any time, subject to applicable laws. The most current version published on the Black Star Radio website will prevail.

Privacy

Personal information collected as part of a promotion will be handled in accordance with Black Star Radio’s Privacy Policy available at https://blackstarradio.com.au.

Back a Local – Promotion Specific Terms

Winner Selection
Back a Local is a judged competition. Winners will be selected based on the quality of their nomination and the positive impact they have made in their community.

All eligible nominations will be judged by Black Star Radio. In selecting the winners, Black Star Radio may consider, but is not limited to:

• The quality and sincerity of the nomination.
• The nominee's positive impact on their community.
• The story and supporting information provided by the nominator.
• Representation of communities across the Black Star Radio Network.
• Any other factors Black Star Radio considers relevant.

Black Star Radio's decision is final and no correspondence will be entered into.

Prize Conditions
Each winner will receive a prize pack with a combined recommended retail value of over $200. Prize values are based on the recommended retail price or the value advised by the relevant prize sponsor.

Prize packs may vary between winners and are subject to availability. Any prizes shown or advertised are indicative only and may differ from those ultimately awarded.

Black Star Radio reserves the right to substitute, amend or vary any prize or prize component with an item of equal or greater value, as determined by Black Star Radio, where necessary, including where a prize is unavailable or to ensure the prize is suitable for the winner's location or individual circumstances.

Prize packs are not transferable, exchangeable or redeemable for cash.

Prize Delivery
Prize packs will be fulfilled and dispatched by the relevant prize sponsor. Winners must provide accurate delivery details to facilitate prize fulfilment. Black Star Radio is not responsible for the delivery, timing, condition or fulfilment of prizes supplied by third-party sponsors.

Nominee Eligibility

To be eligible, nominees must reside in Far North Queensland (FNQ), the Gulf, the Cape or Woorabinda at the time of nomination. The Promoter reserves the right to verify a nominee's place of residence and may deem any nomination ineligible if the residency requirements are not met.

Nominations and Broadcast

By submitting a nomination, the nominator confirms that, to the best of their knowledge, the information provided is true and accurate and that they have the right to provide the information contained in the nomination. Black Star Radio reserves the right to edit, shorten or adapt nominations for clarity, length, suitability, legal compliance or broadcast requirements before publication or broadcast.
